This would actually cover your free speech concerns pretty well. If it would get someone in trouble in NS, it would likely get them in trouble here. www.nationstates.net/page=faq#etiquetteI think it's been specifically suggested not to have an official court or judicial branch, in part to keep with the theme of a wild west frontier settlement. This is one of those times where an old person will tell you that you can trust this, because the founders of the region are pretty fair people. I've seen them support really annoying players, only taking action against them under severe circumstances, and that the lack of an official court system isn't something that would damage Fort Triumph's ability to be both fair and prosperous.

I really like the simplicity of it. It's a wide open foundation that the region can build on instead of having a legal culture set in place for everyone else to follow.

I'd still like to better define citizen. Are we using the definition from 2014 that is archived? Or are we saying anyone who get marked as such on the forum (and what are the qualification for getting mark as such?). I don't want to risk getting over run by another nation's puppets who let say only approve embassy allied with their main region or items like that ect ect, other wise I agree with Shizensky about it being simple, having the constitution as a framework vs a complex item is always better because it allows you to adapt to situations.
I do think however we should include this section
"Citizens and residents shall have the right to manage their nations without interference."
To enumerate the that right.

I can see your point about defining citizenship in the Rules and Orders.
I think enumerated rights should be the first task we citizens tackle in the Town Hall, though. I like the idea of the citizens gathering to determine their protected rights, rather than those rights being gifted by a higher power.

What if the town hall votes to make citizenship based on WA membership? Do we grandfather all prior members in?

I suppose that is a good point. I was working off the principle that the US never really strictly defined what a citizen was. But in the game much stricter requirements can be placed. The idea was let the town hall be able to decide these kinds of things but if the Town agrees that WA membership is too stringent of a requirement for the spirit of the region, then we should enshrine what makes one a citizen in this document. Personally I think we're better off without a WA membership requirement at least for now. But I can't speak to the future

Against WA requirement for basically similar reasons as my argument against making the mayor the Delegate.
But maybe it's easiest to just push Jack's version out there and then see what happens.

I am on the fence about WA requirement because it would dissuade non WA players from joining us as they would be unequal simply by choosing not to participate in that fact of NS. But I'm not sure what else is good measure to ensure we don't end up a puppet region, again though I also don't want to forgo freedom for region security as that is why I came here, the other region I'm in had 0 governmental transparency, in the name of "We can't trust anyone they might be bad." I think maybe just a declaration of Dual Citizenship? If found a player been found to have lied thier citizenship might be revoked? But maybe you all are right about moving forward. I normally would say it's better to act in foresight than to develop reactionary legislation if this does occur but honestly in this instance I may just be acting to cautiously.
So ....Motion to Accept Jack's proposal for the constitution as is.

I'm in favor of taking the next steps towards ratification. Do we hold a vote somewhere for that? I say we ratify it by creating a Thread and having we initial members who are in agreement of it during this refounding post in that thread as a form of signing it. (Since technically we have no constitutional system of voting until it's ratified). It's both thematic to sign founding documents as well as a solution that question.
